Please read these terms and conditions carefully before using our website.
Guests must review, sign, and return the RENTAL AGREEMENT within 48 hours of making their reservation to be considered confirmed.
Arrivals and Departures:
Unless otherwise agreed, check-in time is after 4:00 PM and checkout is no later than 11:00 AM
Early check-ins or late checkouts can be requested for an additional charge. In the event, a guest fails to depart from the property by 11:00 am, with no late checkout arranged, results in RVA Resort Vacations (RVA) being unable to clean and prepare the rental property for the next guest arriving that day. The departing guest agrees to pay damages and costs incurred by RVA; including but not limited to moving the incoming guest to another RVA rental property.
Terms of Payment
Homes and Condos:
For all stays, a NON-REFUNDABLE down payment equal to 25% of the rental rate plus the administration fees and tax (if applicable) will be due at the time of booking, final payment will be due 60 days prior to the arrival date. An automated email reminder will be emailed to you 7 days prior to the balance due date.
Resorts:
For all stays, A deposit of 20% of the total rental rate is due at the time of booking. Final payment is due 15 days prior to the arrival date.
Terms of Cancellation
All cancellations are subject to the following penalty percentages of the total rental fee:
Homes and Condos:
For all stays: cancellation(s) more than 61 days prior to arrival date will result in 100% forfeiture of the total deposit plus the administration fees and tax. There are no refunds for cancellations within 60 days prior to the arrival date resulting in 100% forfeiture of all monies paid. No refunds for early departures. RVA strongly encourages the purchase of independent travel insurance in the event of unforeseen circumstances.
Resorts:
For all stays: reservations canceled up to and including 15 days prior to arrival will result in forfeiture of the administration fee and 100% of the deposit paid; cancellations 14 days or less prior to arrival will result in forfeiture of the administration fee and 100% of all monies paid—no refunds for early departures. RVA strongly encourages the purchase of independent travel insurance in the event of unforeseen circumstances.
In the event of the chosen rental property becoming unavailable for any reason, RVA reserves the right to substitute another property of equal or higher standard within RVA inventory.
RVA reserves the right to cancel any reservation made because of an error, omission, or other unforeseen circumstance. This includes verbal, written, or website errors which may affect the price, availability, or type of property rented.
Force Majeure
RVA will not be held liable for or issue refunds for circumstances beyond its control. Examples of these include but are not limited to, inclement weather, hurricanes, red tide, fire, pandemics, destruction of property, sale of property, water, gas or sewer leaks, fire, or any other damage to the property making it inhabitable or potentially inhabitable. In the event of Force Majeure, RVA will do its best to make alternative arrangements for the guest.
Rental Fees
Fines and Penalties may be assessed for changes in arrival and departure dates where such changes result in the property being vacant during all or part of the original dates.
The amounts as stated are due as calculated and subject to updates if your rental agreement is modified and/or changed by the guest after the time of booking, and an updated rental agreement is sent.
Administration Fee
The administration fee is calculated at 6% of the total rental rate plus applicable tax for reservation(s) of one (1) up to twenty-six (26) nights length of stay. For stays 27 nights or longer, this administration fee is $100.00 plus applicable tax. The administration fee is due at the time of booking and is non-refundable.
Accidental Damage Protection Fee
The guest must notify RVA within twelve (12) hours of arrival if there is already any damage or notable conditions.
A damage protection fee is required in addition to the rate and administration fee. You have an option to choose a $50 non-refundable Accidental Damage Protection Fee which covers up to $1,000 of accidental damage or a $1000 refundable security deposit. The guest shall be responsible for damages over and above the cost of the coverage. Accidental Damage Protection does not cover property abuse or excessive cleaning requirements.
Disputes
Guest(s) understands that if there are any problems or dissatisfaction with the property that this must be addressed directly with RVA during the guest's dates of stay and not after departing the property. Guest(s) agree that they will not request a chargeback or credit to their credit card in connection with any charge made pursuant to this agreement and waive all rights to request a chargeback now or in the future.
Conditions of Premises
You hereby acknowledge that you will not be entitled to any refund for any inoperative appliances or electronics, including by way of example only internet, television, air conditioner/heat, hot tub, or pool. RVA agrees that upon notification of any problem, RVA shall have 24 hours to make every reasonable effort to have such appliance or item promptly repaired in accordance with the property owner’s direction or move you to a unit of equal value.
Furnishings
While all residences conform to the minimum furnishing requirements of RVA all residences are privately owned, decorated, and furnished by the individual owner. Neither RVA nor the owner shall be responsible for providing any additional furnishings or equipment not available or presently existing in the unit at the time the reservation is made. All other items shall be the sole responsibility of the Guest.
Association Rules (for Condos and Resorts Only)
Rental agreements are subject to the rules and regulations of the condominium association of which the owner is a member. Guests agree to abide by all association rules and regulations.
Fines and penalties
Guests will be responsible for any fines, penalties, or citations assessed, either at the time of the incident or after departure, to them individually, to the property, or to RVA during their time of occupancy, including but not limited to noise and parking.
Parking (Resorts and Condos Only)
Each condo has 1 assigned parking spot with one (1) vehicle parking pass per reservation.Boats, RVs, personal watercraft, and trailers are not permitted to park on the premises. Any unauthorized vehicles shall be removed or towed at the guest's expense.
Keys
Resorts and Condos:
All keys or fobs that have been provided to the guest must be returned to the check-in office upon departure. If a guest fails to return these items, a $25.00 lost and/or retrieval fee will be charged to your credit card in addition to any applicable locksmith fees.
Homes:
All keys that have been provided to the guest must be returned to the check-in office upon departure (Garage or gate openers, key fobs, or access cards, are to be left on the kitchen counter at the home upon departure). If a guest fails to return these items, a $25.00 lost and/or retrieval fee will be charged to your credit card. Replacement costs will be charged to your credit card for any lost garage or gate openers, key fobs, and access cards as well as any applicable locksmith charges. Individual replacement costs vary by property.
Valuables
RVA or the homeowner is not responsible for the loss of valuables including money.
In the event a guest leaves a personal item behind in the rental property. RVA will do its best to locate it; however, the owner and the management company are not responsible for any losses. If the item is found, the guest will be responsible for arranging collection, shipment, delivery, and any cost incurred. Any unclaimed items may be donated to charity or disposed of after 30 days.
Pets
Homes and Condos:
Pets are not permitted in most properties unless specifically authorized. If a property accepts pets, RVA, must be notified when making the reservation. The guest will be responsible to complete and return a pet addendum prior to arrival. A daily pet fee of $25 per pet will apply.
Resorts:
Pets are not allowed. Any breach of this policy will result in termination of your rental agreement including possible eviction from the property and possible forfeiture of any monies paid.
Maximum Occupancy
Guest agrees to keep the maximum number of people occupying the premises at/or under the maximum persons allowable. Any breach of the above policies will result in termination of this agreement including possible eviction from the property and possible forfeiture of any monies paid.
Age Requirement
The individual named on the reservation with RVA must be 25 years of age and occupying the unit, persons under 25 years of age are prohibited unless accompanied by a parent or legal guardian staying in the same unit.
Indemnification
RVA shall not be liable to guests, or any other party, for any damage to the property or for injuries to other persons at the premises from any cause whatsoever, including defects in the premises. Guest shall indemnify and hold harmless RVA from and against all liabilities, claims, expenses, fees, loss of use, and actions of any kind arising out of guest(s) use and occupancy of the premises, nor will RVA be liable should the property become unavailable for any reason whatsoever.
Smoking
Smoking is prohibited in all accommodations. A minimum of $200.00 additional cleaning fee will be charged to your credit card upon evidence of any smoking found inside all vacation rentals managed by RVA.
Housekeeping
Please note, our properties are a self-serve environment. A starter kit of personal amenities and paper products is provided in our accommodations, any additional supplies are the responsibility of the guest.
Construction
RVA is not responsible for new or ongoing road construction, nearby building construction, beach refurbishment, or activities or events taking place outside the home’s property line. If staying in a condominium or resort, the building management has the express right to conduct repairs of elevators, pools, pool heat, hot tubs, general areas, and exterior and interior of condominium buildings. These situations are completely out of our control and the guest expressly waives and relinquishes any rights, claims, discounts, or refunds against RVA, the condominium or homeowner associations, affiliates, or the homeowner.
Governing Law
This agreement shall be governed and enforced according to the laws of the State of Florida. The prevailing party in any lawsuit to enforce any provisions of this agreement shall be entitled to an award of attorney(s) fees, costs and expenses for mediation, arbitration and trial or appellate proceedings.
Wildlife and Insects
Florida wildlife may pose a danger.
RVA’s preventative efforts cannot guarantee there will not be an encounter with wildlife, bugs, insects, or pests of all types. Guests agree that RVA cannot be held accountable for encountering any of the above, whether outside or inside, their rental home.
RVA Website
RVA, Resort Vacation Accommodations maintains this site for your personal entertainment, information, education and communication. Please feel free to browse the site; provided, however, that by accessing and browsing this site, you acknowledge and agree, without qualification or limitation, to be bound by these terms, conditions and notices of use (the "Terms"). If you do not agree to the Terms, please do not use Resort Vacation Accommodations. We reserve the right, at our discretion, to change, alter, modify, add, terminate or remove any of the Terms at Resort Vacation Accommodations sole discretion, at any time and with no notice thereof. Please check the Terms each time you use this website. Your continued use of Resort Vacation Accommodations signifies your acceptance of such modifications and Terms.
